Abstract: 

Recognition and enforcement of FOREIGN court judgments is a matter of conflict of courts in legal traditions and due to its political dimension, it is a controversial legal issue. Because, the recognition and enforcement of a FOREIGN judgments means the use of force of sovereignty to enforce the judgment, the national sovereignty have a serious question that how can use the national power to enforce the judgment that had no role in its creation. Especially, it is possible that the laws and regulations relate to this cases is contrary to legal principles, common assumptions or general understandings of justice in a country where it has been requested to recognize or enforce the FOREIGN judgment. With regard to this topic, it could be understood that the recognition and enforcement of FOREIGN judgments in insolvency and bankruptcy how much can be problematic and controversial. This article is not included in the THEORIES of recognition and enforcement of FOREIGN judgments, but it is included in the regimes governing the recognition and enforcement of FOREIGN insolvency judgments. In this context, the discussion about the THEORIES of JURISDICTION in international insolvency will be necessary.

Abstract: 

A B S T R A C TThe morphology of each region is related to its landforms, the morphology of flat areas is related to inselbergs. The presence of inselbergs in desert and dry areas gives a special appearance to the morphology of these areas. The study of these landforms and the effective factors in their formation is considered a necessity in terms of regional development. According to the studies, various factors play a role in the formation of inselbergs, and the role of lithology seems to be more prominent. In this research, which was conducted with the method of field and library studies, we identified 18 inselbergs in Safi Abad plain and by studying them, we came to the conclusion that the inselbergs of this plain are mainly formed in sedimentary rocks such as limestone, conglomerate and sandstone. Among the geological formations, the largest and most diverse inselbergs in the Safiabad plain are formed in the mass conglomerate formation with good hardening because this formation is the most widespread in this plain. But the most typical inselbergs of this plain are formed in thick layered limestone. Because this formation is more resistant to erosion. Lar Formations including Limestone and Thick Limestone’s to Mass Dolomite and Delichai Formations have also played an important role in the formation of inselbergs in this plain. Although the extent of these formations is not significant, but due to their significant resistance to erosion and being far from these processes, they have caused the formation of evolved inselbergs in this plainExtended AbstractIntroductionInselbergs are ridges with a height of less than 500 meters formed with a steep slope in the plains. Their resistance to erosion has caused them to be considered capable players in the morphology of arid and semi-arid regions. Due to their uniqueness in desert areas, these areas are of interest to tourists, and the economic situation of these areas can be improved by attracting tourists. The prominence of inselbergs in desert areas has caused researchers to pay attention to their studies, the most important of which are the studies of Pye in Kenya (1984), Nenonen in Finland (2018), Luiza in Brazil (2021), Laetitia in Africa (2019), and Mashaal in Egypt (2020). Although the conditions for inselberg formation are available in some areas of Iran, and these landforms have given a particular face to the morphology of this country, no significant study has been done on them so far. This research attempts to investigate the role of lithology in inselberg formation in Safi Abad Plain by using library and field studies. MethodologySafi Abad plain in the northeast of Iran and North Khorasan province and in terms of geographical coordinates between 36-˚ 48-05 to 36-22-55˚ North and 37-57˚ East to 36-˚ 37-08 It is located at 57-58-11 east. Field and library studies were used to study the inselbergs of this plain. The entire region was surveyed in 2 years in the field studies, and 18 inselbergs were identified. Then, the location and extent of their expansion were determined. In the morphometry that was done as a survey, the minimum height, length-to-width ratio of inselbergs, and their distance from each other were measured with GPS. The study of the concepts, definitions, and effective processes in inselberg formation was done with the library method. The maps of this research were drawn with Adobe Illustrator software. Results and discussionInselbergs are diverse in terms of morphology; in the studied area, 18 inselbergs were identified, most of which are mixed. Most of them are rocky and have less vegetation. Regarding lithology, inselbergs are particular forms of igneous and metamorphic rocks, but some are also formed in other rocks. Although lithology plays an essential role in inselberg morphology, it cannot be claimed that inselbergs formed in the same formation have the same shape. Although the dominant lithology of the Safi Abad plain is formed from sedimentary rocks, due to the different resistance of its formations, the height, shape, and slope of the inselbergs of this plain are different in different parts of the region. The difference in these characteristics has caused the different shapes of the land in this plain. According to the studies of the most resistant formations of Safi Abad plain against erosion, limestone is a thick layer of chert mass formed due to the resistance against the erosion of the complete inselbergs.After this formation, the Lar formation consists of fine-grained uniform dolomitic limestone with thick to massive layering, which is more resistant; that is why many inselbergs in the region have formed in it. The third formation in terms of resistance is the Apsin-Albin unit, which includes orbitolinate limestone and thick limes to a mass of dolomite. Although this unit has a small area, its inselbergs are closer to typical inselbergs. In terms of area, most of the area is composed of mass conglomerates with good hardening. Due to the different effects of this formation from different processes, its inselbergs do not have the same morphology. The inselbergs formed in this formation are in the middle part of the high area, low in the southern part, incomplete in the western part, and incomplete mushrooms in the path of the Gerati River. After this formation, gray shales are the most resistant to erosion. This formation, which belongs to the Jurassic period, has formed a large part of the northeastern inselbergs. The alternation of limestone and marl in the Delichai formations in the middle part of the region provides the basis for the formation of mushroom-shaped inselbergs in the future. ConclusionSafiabad Plain is in the northeast of Iran, and in terms of geomorphological units, it is part of central Iran. Inselbergs form part of the morphology of this plain. In this study, 18 inselbergs were identified in this plain, and their detailed study showed that their primary skeleton was established by tectonic activities in the Devonian to Miocene period with the formation of Posht Bahram mountains. It was formed when the tectonic activities calmed down and in opposition to the lithology and erosion of the inselbergs of this plain. In terms of lithology, the well-hardened conglomerate formation covers nearly 47% of this plain, and due to its large size and different distances from erosion processes, various inselbergs have been formed in it. The southern inselbergs formed in this formation have a regular shape due to wind and blue erosion. In contrast, the middle inselbergs have an incomplete shape due to the distance from higher erosion, and the western inselbergs have an incomplete shape due to the superiority of blue erosion. Another formation that plays a vital role in this field is Lar Mei Formation. Although this is the second formation in terms of size and strength, many inselbergs have formed in it. The Shemshak formation is placed after the Lar formation in terms of resistance. This formation has caused the formation of chain inselbergs in the northeast of the region. The most typical inselbergs of the region are observed in the thick layered limestones of the formation (Maastrichtian). Also, this research found that inselbergs may be formed in all flat areas of the world and even in sedimentary formations. Abstract: 

Rational discussion guides, but does not compel individual decisions, and the best process of inquiry and decision should vary with a person’s goals and situation. Sir Karl Popper noted that after a result of observation or experiment has been obtained by independent researchers, scientists agree to reject as false THEORIES that are contradicted by accepted facts. Popper, though, wrongly assumed this consensus also applies to acceptance for purposes of research. In reality researchers develop competing THEORIES about which evidence is currently in conflict, and sometimes even refuting the THEORIES in their current form. Further, Popper asserted that only negative arguments should be used in rational inquiry. In reality, productive inquiry involves also positive arguments, even in science. Positive considerations such as which basic THEORIES are justified by the researcher’s preferred metaphysics, or what THEORIES in applied science are justified by existing accepted basic THEORIES, are also used productively

Abstract: 

After offering an overview of some of the main themes of Popper’s political thought, the paper argues that his account faces two problems relating to institutions. The first is that while Popper stresses the ‘rational unity of mankind’, and the potential for any of us to furnish criticisms of public policy, it is not clear what institutional means currently exist for this to enable this to take place. Second, Popper has stressed the conjectural character of even our best THEORIES. However, at any point, some THEORIES will have fared better in the face of criticism than others, and they may give us important information about constraints on our actions. At the same time, as ordinary citizens we may not be in a good position to understand the THEORIES in question, let alone appraise the state of the specialised discussion of them. There is, it is suggested, a case for thinking of ways to institutionally entrench such fallible THEORIES, especially in the current setting in which social media play an important role

Abstract: 

Our analysis of Popper’s philosophy of science focuses on his concepts of tradition and situational analysis. These concepts represent innovative Popperian contributions to a historical and hermeneutical turn in philosophy of science that most of his critics, especially Kuhn, fail to recognize. According to his historical view, Popper conceives sciences as a complex of traditions in continuous transformation and progress by means of rational discussion of THEORIES. In order to grasp the rational progress of scientific traditions, Popper proposes an original method that he calls “situational analysis”. This hermeneutical method seeks to understand the concepts, hypotheses, actions, practices, controversies and products that scientists made to solve problems in their specific historical contexts to improve the truth content of THEORIES. In addition to his historical and hermeneutical turn, Popper also inquired about the social and political conditions for the progress of scientific traditions by means of intersubjective criticism of THEORIES and conjectures. According to him, the rational discussion of ideas requires, as necessary conditions, plurality of ideas, intellectual humility, and freedom of thought and communication that can only exist in an open and democratic society. With these considerations, we may say that in addition to a historical and hermeneutical turn, Popper also contributed to a social and political turn in the philosophy of science

Abstract: 

The reception of Popper in Japan has not been a glorious history up to the present day. There have been numerous misunderstandings and distortions. It is important to record and discuss them in order to learn from them and to make use of his ideas in the Japanese intellectual climate. This is the purpose of the present paper. From the perspective of the reception history, we searched the reasons why Popper has been misunderstood in Japan (especially in four areas: philosophy, economics, history, and political philosophy), and tried to identify some of the factors responsible for this misunderstanding. To this end, we applied the method of “situational analysis” to the Japanese peculiar intellectual situation after the so-called après guerres, rather than by using a chronological order. If the causes of misunderstandings and distortions in Japan can be clarified by means of a situational analysis, we can learn a great deal from this history and can use this knowledge to throw new light on the status of critical rationalism in Japan

Abstract: 

Four important ways of religious education in the field of beliefs are inferred in this article through the nature of religion in the Holy Quran. We have examined two categories of “nature of religion” and “methods of religious education” for this purpose. All verses including the root of “د ـ ی ـ ن” (religion) have been investigated in order to properly understand the nature of religion in the Holy Quran. Then, we have benefited from the inference method to find the ways of religious education in the Holy Quran. In the inferential method, we have reached the “conclusion”, which is the method of religious education by using two premises, “normative” and “realistic”. The solutions of the Holy Quran to achieve the methods of religious education are explained in the following. For example, using the Scriptures directly to know the right actions is one of the solutions of the Holy Quran to reach the way of believing in the punishment of deeds. The achievement of religious education methods through discovering the nature of religion and explaining the purpose of education on the one hand and using the inferential method as a research method on the other hand is one of the innovations of this research. The achievements of this paper can be used to provide an educational theoretical model for formal and public education system.

Abstract: 

A B S T R A C T Green city is one of the approaches to sustainable development. “green city” is an environmentally friendly city compatible with the concept of sustainable development and can be used for the welfare and security of its inhabitants. Based on the concept of a “green city,” urban managers try to have the least destructive effect on the ecosystems upon which cities rely. Green city is one of the sustainable development approaches that reduce the environmental footprint of cities. The purpose of this study is to evaluate the situation of Mashhad metropolis in terms of the objective characteristics of the green city. In this study, 14 indicators of electricity consumption per capita, green space per capita, population density, water availability, sewage availability, superior public transportation network, urban mass transportation, traffic reduction, annual production waste per capita, carbon monoxide, concentration nitrogen dioxide, sulfur dioxide concentration, particulate matter concentration, and air quality were exerted. To determine the importance of research indicators, the Shannon entropy method, and the status of Mashhad city areas in terms of green city indicators, the VIKOR multi-criteria decision-making method has been applied. The results showed that most areas of Mashhad are average and below average in terms of green city characteristics, and only District 9 is in very good condition (0.636). Also, based on the results of this part of the research, District 5, with the value of VIKOR index of 0.969, is in the last rank in terms of objective characteristics of the green city Extended Abstract Introduction Green city is one of the approaches to sustainable development. Based on the concept of a “green city,” urban managers try to have the least destructive effect on the ecosystems upon which cities rely. Green cities constantly try to manage their environmental effects by reducing waste, increasing recycling, reducing air pollution, increasing population density, developing open urban spaces, and encouraging the development of sustainable local businesses. Green cities were first used to evaluate 30 European cities by the Economist Intelligence Unit (EIU) in 2009 with the financial support of Siemens and the aim of reducing the environmental effects of human activities in cities. In that study, eight indices of carbon dioxide, energy, construction, transportation, water, recycling and land use, air quality, and environmental governance were used. Later, the Economist Intelligence Unit, with the financial support of Siemens, evaluated the status of the green city index in 17 Latin American cities, 15 African cities, 22 major Asian cities, and 27 cities in United States, Canada, Australia, and New Zealand. In recent years, even some Western Islamic scholars have, in various publications, shown that Islam is an ecological religion. In Iran, the issue of protecting the environment has not received much attention regardless of its rich cultural and religious background and its confirmation in Article 50 of the Constitution of the Islamic Republic of Iran. Mashhad is the second metropolis of Iran, located in North-East of Iran, and is one of the counties of Khorasan Razavi Province. According to the 2016 Iranian Population and Housing Census, its population was 3057679 people (The Vice-Presidency of Planning and Development of Mashhad Municipality). In Mashhad, due to several reasons including the presence of Imam Reza Shrine (PBUH) and arrival of millions of pilgrims per year, population growth, increased garbage production (production of 896534 tons of garbage in 2016 (The Vice-Presidency of Planning and Development of Mashhad Municipality), air pollution (increased number of unhealthy days from 46 days per year in 2015 to 88 days in 2016 for sensitive groups and 4 days of unhealthy air for all groups in 2016 (Center for Monitoring Environmental Pollutants of Mashhad Municipality) the 2025 vision of the city has paid attention to the environment in the form of five general objectives; however, just like the national level, no specific pattern for environmentally-compatible urban development, such as green city, is determined. Analysis of the green city index in Mashhad metropolis can considerably contribute to urban managers and planners in addition to providing a pattern for evaluating the present situation in other cities of Iran and improving the quality of life regardless of the current status of the urban environment in Iranian cities; we can preserve these environments as parts of the natural environment for future generations.   Methodology In terms of its goal, the present study is an applied one; in the study, drawing upon other studies and library sources and considering the conditions of Iran and the metropolis of Mashhad in terms of green city, 14 quantitative indices were exerted. To this end, the required data for the quantitative indices was gathered by library research from the relevant institutions. Next, the weights of quantitative indices were determined using Shannon's entropy. Then, using the VIKOR method of multi-criteria decision-making, the status of various districts of the metropolis of Mashhad in terms of quantitative indices of green city was determined. Finally, the map of the spatial distribution of quantitative indices was drawn using the ARC GIS software package.   Results and discussion In this study, to analyze the status of the metropolis of Mashhad in terms of green city features, 14 quantitative indices were used. Considering the value of the VIKOR index ranges from 0 to 1, various districts of Mashhad can be classified into five categories; very satisfactory, satisfactory, average, unsatisfactory, and very unsatisfactory in terms of quantitative indices of green city. The results of the current situation of Mashhad showed that in terms of objective indicators of the green city, District 9 of Mashhad metropolis with a value of VIKOR index of 0.056 is in first place, and the seventh region with a value of VIKOR index of 0.433 is in second place. Also, based on the results of this part of the research, District 5, with the value of VIKOR index of 0.969, is in the last rank in terms of objective characteristics of the green city.   Conclusion Similarly, the results of studies by Afshar (2011) and Shabani et al. (2017) on Tehran metropolis are indicative of the unsatisfactory situation of Tehran (the biggest metropolis of Iran) in terms of green city features. Comparing the results of the studies by Afshar (2011) and Shabani et al. (2017) with the present study on Mashhad (the second biggest metropolis of Iran) reveals the necessity for a comprehensive plan toward achieving green cities. It should be mentioned that, due to the specific conditions of Mashhad metropolis and availability or unavailability of the required data, the indices used in the present study are somewhat different from the ones used by Afshar (2011) and Shabani et al. Abstract: 

Coronvirus desies and its consequences have caused concern among various segments of society. In particular, the change in teaching methods from online to face-to-face training and the damage caused by this process in some cases has made this educational process difficult. Thus, identifying students' concerns and understanding the predictions of anxiety in the reopening of educational institutions will allow us to address the roots of this factor after the Corona epidemic and the reopening of schools.. This research is a qualitative research and content analysis and its statistical population is high school students in Tehran at the time of reopening of schools after the Corona epidemic. From this statistical population, 40 male and female subjects who met the research criteria were selected. After interviewing the subjects and analyzing them, sub-themes and main themes have been identified and classified.
